By enrolling in the Healthy Body Results Club SMS service on our website, you agree to become a part of the Healthy Body Results Club Service and acknowledge the following Terms of Use. Additionally, you consent to receiving messages on your mobile phone. Kindly note that subscribing means you will receive recurring messages.

Fees:

Participating in the Healthy Body Results Club Service is free of charge. However, standard message and data rates may apply from your wireless carrier. We recommend checking with your wireless carrier for information on applicable text messaging fees. Please be aware that Healthy Body Results will not be held responsible for any fees charged by your wireless carrier for using the Healthy Body Results Club service.

Privacy:

Usage Limitations:

To register for and use the Healthy Body Results Club service, you must be at least 17 years old. If you are under 17 years old, please obtain permission from your parents or legal guardians before signing up for the Healthy Body Results Club service.

Supported Carriers:

Please note that mobile carriers are not responsible for delayed or undelivered messages. Participating carriers include T-Mobile®, Verizon Wireless, AT&T, Sprint, Boost, U.S. Cellular®, MetroPCS, Virgin Mobile, and Cricket.

Support Issues, Cancellation, or Unsubscribing:

If you wish to opt-out of the Healthy Body Results Club service at any time, you can do so by texting STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL to {Insert Program Code}. Standard message and data rates may apply. Alternatively, you can send an email to [email protected] with your mobile phone number as the subject line. For assistance or other support issues, you can also send an email to [email protected], text HELP to {Insert Program Code} from your mobile phone, or call the toll-free phone number: 877-245-9982.

Ownership; Trademarks; Modifications to Offers:

By using the Healthy Body Results Club services and any offers provided through it, you agree that Healthy Body Results or its partners will retain all legal rights, titles, and interests, including any intellectual property rights. You are not allowed to alter or modify any offers made through the Healthy Body Results Club service, and you must not remove, obscure, or alter any proprietary rights notices (such as copyright or trademark notices) affixed to the Healthy Body Results Club services or offers. Unless expressly authorized by a partner, you agree not to use any Trademark, service mark, trade name, or logo (“Trademarks”) of any entity in a way that may cause confusion about Trademark ownership or be detrimental to the goodwill of such Trademarks.

Termination:

Healthy Body Results reserves the right to terminate your subscription at any time without notice or future obligation.

Disclaimer of Warranties:

The Healthy Body Results Club service is provided “as is” and “as available,” and Healthy Body Results provides no warranties, express or implied, regarding the service. This includes but is not limited to any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Factors beyond Healthy Body Results’ control, such as mobile carrier network speed and internet performance, may affect the service’s performance, and Healthy Body Results is not responsible for any acts beyond its control.

Limitation of Liability:

Under no circumstances shall Healthy Body Results, its officers, directors, employees, or agents be liable to you for any damages whatsoever arising from your use of the Healthy Body Results Club service. This includes direct, indirect, incidental, consequential, exemplary, or special damages, even if advised of the possibility of such damages. If applicable law prohibits any disclaimer or limitation on damages or liability set forth herein in a particular circumstance, Healthy Body Results shall be entitled to the maximum disclaimers and/or limitations on damages and liability available by such applicable law in that particular circumstance. However, in no event shall Healthy Body Results’ liability for damages arising under these Terms of Use or your use of the Healthy Body Results Club service exceed US $500.

Indemnity:

You agree to indemnify and hold each Company party harmless from any claim or demand, and any damages, costs, or expenses arising in connection with such claim or demand, including reasonable attorneys’ fees and costs, made by any other party due to or arising out of your breach of this agreement or the documents it incorporates by reference, or your violation of any law or the right of another party.

Governing Law; Venue:

This agreement and its validity, construction, and performance will be governed in all respects by the laws of the state of Oregon, without regard to its choice of law provisions. You irrevocably agree to accept the exclusive personal jurisdiction and waive any objections to the venue of such courts.
